“Say Cheese” Photo Sweepstakes
NO PURCHASE NECESSARY TO ENTER.

MUST BE 18 YEARS OF AGE OR OLDER AND HAVE INTERNET ACCESS.

1. ELIGIBILITY: The Fast Park “Say Cheese” Photo Sweepstakes (the “Sweepstakes”) begins at approximately 12:00 PM Eastern Time (“ET”) on 6/7/2019 and  occurs during each Giveaway Entry Period.   Entries will be accepted during the ten “Giveaway Entry Periods” described below :

• 12:00 PM ET on 6/7/2019 through 11:59:59 AM ET on 6/10/2019;
• 12:00 PM ET on 6/14/2019 through 11:59:59 AM ET on 6/17/2019;
• 12:00 PM ET on 6/21/2019 through 11:59:59 AM ET on 6/24/2019;
• 12:00 PM ET on 6/28/2019 through 11:59:59 AM ET on 7/1/2019;
• 12:00 PM ET on 7/5/2019 through 11:59:59 AM ET on 7/8/2019;
• 12:00 PM ET on 7/12/2019 through 11:59:59 AM ET on 7/15/2019;
• 12:00 PM ET on 7/19/2019 through 11:59:59 AM ET on 7/22/2019;

There is a limit of one (1) entry per person during each of the 10 Giveaway Entry Periods. Employees of Parking Company of America, Inc. d/b/a Star Parking, Fast Park & Relax, Fast Park 2, Airport Fast Park, Park Place Airport Parking and Park Place (“Sponsor”), Sponsor’s advertising/promotions agencies, their respective parent, subsidiary, and affiliated companies, and the immediate family members of the foregoing residing in the same household are not eligible to participate. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor.

2. HOW TO ENTER: During the Giveaway Entry Period,  Entrants must enter via the Fast Park Instagram account within the Instagram app. To enter, entrants must comment on the appropriate post and share an appropriate photo using the designated hashtag below for the designated entry period:

To enter via Instagram, entrants must be following the Fast Park Instagram account. Entries made using an automated entry device of any kind will be disqualified. Entry forms are not applicable to this promotion and are not necessary to win.

No purchase is necessary to enter, but an Internet connection and mobile device is required. Mobile phone data rates may apply.. Entries made using an automated entry device of any kind will be disqualified. All entries become the property of Sponsor and will not be acknowledged or returned.

By submitting an entry, entrants agree that the post (and each individual component thereof – including, without limitation, the photo) complies with all conditions stated in these rules. The Sponsor will bear no liability whatsoever regarding the use of all entries or any component thereof – including, without limitation, the photo. The Sponsor shall be held harmless in the event it is subsequently discovered that an entry has departed from or not fully complied with any of these rules and/or the Instagram rules.

By participating in the Sweepstakes, each entrant hereby warrants and represents that any Entry submitted:

1. Is original to the entrant;
2. Does not violate any law, statute, ordinance or regulation;
3. Is made from a  public account ;
4. Will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and
5. Is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third-party products, trademarks, brands and/or logos, other than those of Sponsor); conduct or other activities in violation of these Rules; and/or any other comment that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

Entry into the Contest constitutes acceptance of these Official Rules in their entirety.

3. DRAWING/PRIZES: A winner will be randomly chosen from all entrants who comment on the appropriate post and hashtag an appropriate photo within the time period specified in the post within each Giveaway Entry Period. Comments submitted via any other method (e.g., e-mail) will not be accepted. All decisions of the judges shall be final. Prizes include one Free Day of parking at the entrants chosen Fast Park facility and a Fast Park FunTime FastPak.

The approximate retail value (ARV) for each prize to be awarded is $20. The odds of winning a weekly Prize  will depend on the total number of eligible entries received in each of the Giveaway Periods. All Prizes will be awarded unless Sponsor cannot obtain requisite Affidavits or other documents from potential winners in a timely manner, (3 days from first notification attempt) in which case all Prizes may not be awarded. Winner is responsible for all costs and expenses not specifically stated as being included herein including, but not limited to, taxes and all personal costs and expenses. Prizes will be automatically uploaded to the winner’s Relax for Rewards account and shipped to each Winner.

4. AGREEMENT TO RULES: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Sponsor as final and binding as it relates to the sweepstakes.. Any Entry that does not comply with the Entry Requirements, or otherwise with these Official Rules will be void, eliminated and not eligible for consideration.

5. CONDITIONS: There is a limit of one Prize per person during each of the 10 Giveaway Entry Periods. All Prize Winners must have a Relax for Rewards Account.  All Prize Winners will be required to execute an Affidavit of Eligibility and Liability/Publicity Release, or provide other documentation requested by Sponsor, in its discretion. If Sponsor is unable to receive personal confirmation from a Winner of being selected as a Winner within three (3) days from the first notification attempt, or if a Winner (i) fails to complete and return all requested documents by the date specified by the Sponsor, (ii) is found to be ineligible, or (iii) fails to comply with the Official Rules, the Prize will be forfeited and an alternate winner will be selected from among all remaining eligible entries. In the event of any difference between the stated ARV and the actual cost of the Prize, no refund or payment for any difference will be provided. The acceptance of the Prize constitutes permission for Sponsor to use the Winner’s name and address (city and state) for promotional purposes on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation. Each Winner is responsible for all federal, state and local taxes on the Prize. Each Entrant agrees to release, discharge, indemnify, and hold harmless the Sponsor, the Administrator, Instagram, and their respective parent companies, affiliates, directors, officers, employees, and agents, from any claims due to any injuries, damages, or losses to any person (including death) or property, resulting in whole or in part from acceptance or use of the Prize, or participation in the Sweepstakes. No refund or value will be provided if a Prize is not or cannot be used or is otherwise declined. A purchase will not increase chances of winning. Headlines are for convenience only.

6. RIGHTS GRANTED BY YOU: By entering this Sweepstakes you understand that Sponsor, anyone acting on behalf of Sponsor, or its respective licensees, successors and assigns will have the right, where permitted by law, without any further notice, review or consent, to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the entry and winner's name, portrait, picture, voice, likeness, image or statements about the Sweepstakes, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further notice.

7. LIMITATIONS OF LIABILITY: Sponsor, Administrator, and Instagram and their respective parents, subsidiaries and affiliated companies, advertising, promotion or production agencies and all of their respective officers, directors, representatives, agents and employees are not responsible for lost, late, delayed, inaccurate, incomplete, or misdirected entries, or for electronic, network or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmissions that may limit a user’s ability to participate in this Sweepstakes, or for other hardware, software or technical errors of any kind including any injury or damage to any person’s computer related to or resulting from participating in the Sweepstakes, or for other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise, relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, or with respect to any Sweepstakes-related materials. Sponsor is not responsible for lost, stolen or misdirected shipments. Entrants agree to be bound by these Official Rules and the decisions of the Sponsor whose decisions are final. Entrants waive any right to claim ambiguity with regard to the mechanics of the Sweepstakes or the interpretation of the Official Rules. Anyone attempting to defraud or tamper with this Sweepstakes will be declared ineligible and may be prosecuted. Sponsor is not responsible or liable for any loss, damage, inconvenience, or loss of time arising out of any acts, omissions, or negligence, of any person, including, without limitation, transportation carriers and any person providing any service or accommodation in conjunction with the Prize, or for delays or cancellations including, but not limited to, those resulting from mechanical breakdown, closings, strikes, government action, inclement weather, or Acts of God. Sponsor is not responsible for incorrect information caused by printing, technical, or human errors which may occur during the Sweepstakes. Sponsor assumes no responsibility for errors, omissions, interruptions, deletions, defects, delays, or the theft, loss, or destruction of entries. If, for any reason, the Sweepstakes is not capable of being conducted as planned because of tampering, intervention, fraud, technical failures, or any other reason (each an “Intervening Cause”), which affects the security, fairness, or proper execution of the Sweepstakes, Sponsor reserves the right to modify or cancel the Sweepstakes if prior to the end of  each Giveaway Entry Period, or otherwise award the Prize through a drawing from all eligible entries received which, in Sponsor’s opinion, were not affected by the Intervening Cause. Any disputes regarding this Sweepstakes shall be governed by Ohio law and resolved in courts located in Hamilton County, Ohio. Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred but in no event attorney fees. Entrants waive any claim for punitive, incidental or consequential damages. With regard to the Prize awarded, Sponsor makes no express or implied warranty of merchantability or fitness for a particular purpose. Personal information provided to participate in the Sweepstakes is subject to Sponsor’s Privacy Policy found at http://www.thefastpark.com/home/privacy-policy/ . Void where prohibited.

8. DISPUTES: This Contest is governed by the laws of Ohio, without respect to conflict of law doctrines.  As a condition of participating in this Contest, participant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Ohio having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim, punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e. costs associated with entering this Contest), and participant further waives all rights to have damages multiplied or increased.

9. WINNER’S LIST: For the names and addresses (city and state) of the Winners, send a self-addressed stamped envelope postmarked by 8/19/2019 to: Fast Park “Say Cheese” Photo Sweepstakes Winner’s List, Fast Park, 250 West Court Street, Suite 200E, Cincinnati, OH 45202.

10. SPONSOR AND ADMINISTRATOR: Sweepstakes is sponsored by Parking Company of America, Inc, Cincinnati, OH and administered by Vehr Communications, 700 Walnut Street, Suite 450, Cincinnati, OH 45202 (the “Administrator”).Instagram does not endorse Sponsor’s products and is not affiliated with the Sweepstakes. Information provided to enter the Sweepstakes is being provided to Sponsor and not to Instagram.

11. SPONSOR’S RESERVATION OF RIGHTS: These official rules are subject to modification by Parking Company of America, Inc.. In the event of a dispute, all decisions made by Parking Company of America, Inc. are final and binding. Parking Company of America, Inc. reserves the right, in its sole discretion, to disqualify any person who tampers with the entry process or the operation of the Parking Company of America, Inc. website or otherwise acts in violation of these official rules. Parking Company of America, Inc. further reserves the right in its sole discretion, to cancel, terminate or modify this promotion if, for any reason, the promotion is not capable of completion as planned (including, but not limited to, for the following reasons: infection by computer virus, technical corruption, force majeure, or non-authorized human intervention that compromises or affects the administration, fairness, integrity, security or proper conduct of the promotion).
